By creating an account with MyAccountability.coach ("the Service"), operated by Performance Elevated ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not create an account or use the Service.
MyAccountability.coach is a daily accountability platform that delivers personalized check-in questions to users via SMS text message. Users create accountability tracks with custom questions, receive daily text messages at their chosen time, reply with their answers, and optionally designate an accountability partner who receives a summary of their responses. The Service also offers goal tracking, streaks, badges, and coach/group management features.
The core service is delivered via SMS text messages sent to the mobile phone number you provide during account creation. By creating an account and checking the SMS consent checkbox on our signup form, you expressly consent to receive recurring automated SMS messages from MyAccountability.coach, including but not limited to:
Message frequency varies based on your active tracks, typically 2-4 messages per day during active sprints. Message and data rates may apply depending on your mobile carrier and plan. Consent to receive SMS messages is not a condition of purchasing any goods or services.
You opt in to receive SMS messages exclusively through our web-based signup form at myaccountability.coach/pages/signup.html. The signup form includes an unchecked-by-default consent checkbox that you must manually check before your account can be created. This consent is specific to the MyAccountability.coach messaging program and is not bundled into any other agreement. By checking the consent checkbox, you are providing direct, campaign-specific consent to receive recurring SMS messages from MyAccountability.coach at the phone number you provide.
You may opt out of SMS messages at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any message from MyAccountability.coach. After opting out, you will receive one final confirmation message and no further SMS messages will be sent. You may re-subscribe by replying START. You may also contact support@myaccountability.coach to request opt-out.
You may reply HELP to any message to receive assistance, or contact support@myaccountability.coach.
Your mobile phone number, opt-in status, and any information collected through SMS messages will not be sold, shared, rented, or disclosed to any third parties for marketing or promotional purposes. Your mobile information is used exclusively to deliver the MyAccountability.coach service. We do not engage in affiliate marketing, third-party lead generation, or any use of consumer opt-in data for purposes other than delivering this specific messaging program. The only third party that processes your mobile information is Twilio, our SMS delivery provider, which is contractually prohibited from using your data for any purpose other than delivering messages on our behalf.
You must be 18 years of age or older, or have parent/guardian consent, to use the Service. You are responsible for the accuracy of all account information you provide.
Paid plans are billed monthly through Stripe. All plans include a 14-day free trial. You may cancel your subscription at any time; access continues through the end of the current billing period. No refunds are provided for partial months. Subscription plans and pricing are listed at myaccountability.coach.
By designating an accountability partner, you consent to sharing your check-in summary data (completion rates and spirit word) with that individual via SMS or email. You may add, change, or remove your accountability partner at any time through your account settings.
You may not use the Service to harass, abuse, threaten, or spam any individual. You may not use the Service for any illegal purpose or in violation of any applicable law or regulation.
The Service design, software, branding, and content are the property of Performance Elevated. Your questions, responses, and personal data remain yours.
MyAccountability.coach is a personal accountability tool. It is not a substitute for medical, psychological, legal, financial, or professional advice. The Service is provided "as is" without warranties of any kind.
Performance Elevated shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to missed, delayed, or undelivered messages.
We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance.
These Terms are governed by the laws of the State of Oregon.
